ebay india & maxtechnoloiges – Cheating by seller – sold refurbished item instead of new item

I have bought “NEW HP PAVILION 15 TOUCH CORE I5 4TH GEN 12GB RAM 1TB HDD WINDOWS 8.1 ENVY” from “maxtechnoloiges” through ebay on 26-6-2015 with paisa pay id 39583394046

Seller description says “condition: new’ but Details of product number is : G6U21UAR#ABA which means refurbished. This is a proof that the item is not as described.

As per HP pavilion p143cl notebook PC product specification for new laptop the bluetooth option is available in wireless connectivity option. But the seller sent me refurbished item without bluetooth option. I have tried to resolve the issue through ebay guarantee for refund (claim id 1097116). They requested to reship the item back to seller, but my experience with the customer care is bad and I am not able to contact them when I want. Having alraedy cheated once, I don’t have trust on the seller also.
Hence I requested for 1) Either you send the new laptop with same configuration as found in hp site and take back the old one. (Ensure to send, from the product number, the item is new and not refurbished. or 2) Refund at least 25% of the laptop cost for sending the refurbished item in place of promised “new one” along with Bluetooth 4.0 tongle compatible with the laptop. But the claim was closed unilaterally in favour of seller.

Now ebay has cheated me by the selling refurbished item in place of new item from maxtechnoloiges.

kindly arrange for replacement with the new item or suitable compensation as requested.
