I, Raghavendra Udupa and my wife Mythily Raghavendra have booked a 3 room flat with Dreamz GK Infra Ltd on 26th January 2015. The project was named as SIDDHI 2, in Electronic City, Bangalore. Total price of flat agreed was that of 19.5 Lakhs, Dreamz GK promised to start construction within 2 months of booking (March 2015), complete and handover the flat by January 2016. Booking amount was 1 Lakh on the day of booking and additional 5 lakhs within 15 day of booking. Total 6 lakhs were paid by February 2015, out of which 5 lakhs were paid through credit card. Receipts were given by Dreamz along with sales agreement draft. The project did not start in March 2015 as promised. We waited for the project to start till December 2015, still the project did not start. There was no concrete answer from Dreamz about the future of the said project. We decided to opt out of the engagement and conveyed our intention. Dreamz tried to sell alternative options, finally agreed for cancellation and collected all booking receipts back. I have kept a copy of the same. Dreamz gave a post dated check for Rs. 590000 on January 2016, for the future date of June 4th 2016. It was SBI cheque. Rs. 10000 were deducted towards card payment, which was not communicated during the receipt of payment through card. No interest amount was included for the period of 16 months.
The cheque got bounced for insufficient funds on June 4th 2016. The same was returned by Bank. I have preserved the same.
I served a mail notice on 8th of June to Dreamz about the cheque bouncing. They responded that the amount will be paid by 10th of July 2016. I made 2 visits since 10th of July to their office near Silk Board, but there is no sign of honoring their commitment.
I am in the fear of losing the money as they are continuously defaulting on their promises.
Please consider this as complaint and advise me the future course of actions to get my hard earned money back with interest. I have copies of their receipts, bounced cheque, and mail communication copies.
