  1. Possession of flats delayed: Real estate company told to refund, compensate three complainants
    More
While disposing of three separate complaints through one judgment, State Consumer Disputes Redressal Commission directed a leading real-estate company to pay a compensation of Rs 9 lakh (Rs 3 lakh each) in all to all three complainants.
The complainants, Kulwant Kaur, resident of Sector 37, Bharti Khanna, resident of Sector 42 and Tejinder Singh, resident of Sector 50 had filed a case in the consumer court as Unitech Ltd had not allotted their flats as promised.
The commission also asked Unitech to refund Rs 25.75 lakh, Rs 27.82 lakh and Rs 23.96 to the three complainants along with Rs 50,000 each as cost of litigation. The orders in the three complaints were pronounced on June 9.
Unitech Limited had started a project in the name of Uniworld City in Mohali.
When the three complainants came to know about the project, they booked one residential flat each in Uniworld City, Sector 97, Mohali.
The total amount to be paid for the flat was between
Rs 25 lakh to Rs 29 lakh, excluding service tax and club membership.
The three complainants stated in three separate complaints that the officials of the company had to provide roads, streetlights, electricity, sewerage connectivity and other facilities within a few months before the completion of the building, at the time of booking.
The company had promised to provide all the facilities within three years from the date of agreement.
The three complainants opted for construction linked payment plan and paid the booking amount of Rs 2 to Rs 3 lakh each in the three separate complaints.
The possession of the said flat was to be given within 36 months, from the date of execution of the agreement that was February 8, 2011 but it has not been given as yet.
Hence, a case was filed in the consumer court on March 4, this year.
The builder in its reply stated that the state commission has got no territorial jurisdiction to pursue the complaint because the said agreement was executed between the parties at New Delhi. It was, further, stated that the complainant did not fall within the definition of “consumer” because the complainant is simply an investor, who invested in the said flat for re-sell purposes but she could not resell the said property, due to slump in the real estate market.

I booked apartment in Glitters. Very Very bad construction….Very delay in hand over. nearly 2 years delay. still. I am very much affected by Antony builders. No Quality of work. Once your registration is completed..that’s it..you are done. no one will hear you..you have to cry,,and sleep less nights…
Agreement is 100% favor to builders. Work is completed with the non-experience people..even the room is not like in the measurement mentioned in the sketch.
If you ask for any additional work..it’s very costly..even for small extra work you have to pay more..
There is no communication between the workers..then will keep on change the engineers…so when you request a work they don’t notify in paper at all…
VERY VERY BAD BUILLDER. PLEASE DONT SUFFER IN FUTURE.

    Dear Leniders,
There is no point in writing negative feedbacks about the company now. While the pain that everyone is going through is understandable (I am going through the same, as I am paying PEMI to India Bulls & also paying rent for the current home) We have all bought apartments in Lenid & have doled out 90% of the total cost of the apartment. There is no way for us to go back, rather we can start to look forward. As a first step let us form an association. Any comments, feedbacks & suggestions are welcome.

Antony Builders MD Mr Antony is systemically cheating the customers. He is not finishing any of the projects for the past 2 years. Antony’s Mon Rev project was a total failure. One should visit the site to see the sufferings of the people who forcibly entered to occupy their flats without basic amenities. Project Tremain with 155 flats hanging on for more than 2 years (it was launched in February 2012). I am one of the victims in their Tremain project, paying EMI for more than 3 years without seeing the light of the day. Le Nid is another project which had not yet taken off.
I filed a case against Antony and won in the consumer court, But he is not honouring the court judgement. But law will prevail upon him at the end certainly but will take some more period. Today I saw a news item covering AJS Builders of Delhi and like Antony that Builder was also not honouring the court decisions and finally ordered to be imprisoned and they now started repaying the 100’s of customers their money to evade the arrest. It is high time, either the individuals go ahead to file the case against Antony or convince their respective buyers’ associations to do the same.
One interesting development with regard to AJS Builders, Delhi was that the buyers also joined together to file complaint against the builder in the Economic Offences Wing apart from pursuing their legal cases. The cheating builders should now draw the lessons from AJS Builders episode.

    Vikas,
Unfortunately the buyers who are in reality consumers, after paying so much money to a cheat builder who does not value the pains of the customers who pay their hard earned money (some paying huge EMIs) do not realize the need to be united in their fight against the builder. Also they do not approach the consumer court fearing that the builder will discriminate them. It is all advantage to builders – particularly people like Antony who divert the public money. It is going to be nearly 4 years after the launch of the “Tremain” Project and the work is in slow progress that too only in one block consisting of 61 flats. There is absolutely no work going on in the other block (consisting more than 90 flats) even now.
I do not know when our fellow buyers will realize their rights?
    Thanks
    Ravi
